Irrespective of the delivery platform you use or of how the City News Content (defined below) is delivered to or accessed by you, by accessing and/or subscribing to and/or using City News website and the online content/services available on it (”City News Content”) you are agreeing to be bound by these terms and conditions. If you use City News website in the course of your business, you are also agreeing to these terms and conditions on behalf of that business and should also read the section regarding At Work Use.

City News Website - Privacy Statement
These terms and conditions were last updated on 16 October 2008 and replace all previous terms and conditions for City News website.
City News may change, alter or withdraw any part of City News website at any time (with or without notice to you) and may also change the terms and conditions. City News will publish details of any changes to the terms and conditions in Section 12 below. You should regularly check Section 12 of these terms and conditions to see if any changes have been made - by using City News website after we have posted the changes, you are agreeing to be bound by them. If you do not agree to the changes you should cease to use City News website.
References in these terms and conditions to “City News” (or “we”, “us” or “our”) refer to the company operating the City News website, see the Corporate Information section below for more details.
From time to time City News may run or permit to be run competitions, promotions, advertisements and surveys on City News website. These are subject to additional terms and conditions that will be made available at the time they are run.
1. Access and Use
City News reserves the right to change the manner in which City News Content is made available or accessible to users.
Permitted Use: All City News Content belongs to City News or its licensors. City News or its licensors own all intellectual property rights (including copyright and database rights) in the City News Content and any selection or arrangement of the City News Content. You may for your personal and non-commercial use:
- retrieve and display City News Content on any compatible device;
- print a single copy of individual articles on paper (but not photocopy them); and
- store such articles in electronic form on disk or on a mobile device (but not on any
server or other storage device connected to a network).
You may also on an occasional and infrequent basis email headlines appearing on the City News website (but not full text articles) to a maximum of five individuals using our ‘Email Article’ service, provided that you shall not use this function for the purpose of either creating a commercial or revenue-generating service or regular information dissemination within any organization or other entity: if you would like to use the City News website headlines in this way please refer to the “At Work Use” paragraph below.
Restrictions on Use: You may not use the City News website for any unlawful purpose. Except as expressly set out above, you may not copy, reproduce, publish, broadcast, transmit, modify, adapt, create derivative works of, store, archive, publicly display or in any way commercially exploit any of the City News Content. Without limitation, you may not do any of the following without prior written permission from City News (and neither may you allow a third party to do any of the same):
- redistribute any of the City News Content, including our headlines (including by using it as part of any syndication, news or content aggregation, library, archive or similar service); or
- deep link to, frame, spider, harvest or scrape the City News Content or otherwise access the City News Content for similar purposes; or
- create a database in electronic or structured manual form by systematically and/or regularly downloading/printing and storing all or any of the City News Content; or
- remove the copyright or trade mark notice from any copies of City News Content made under these terms and conditions; or
- use any machine, electronic, web based or similar device to read or extract the City News Content by automated or machine based means.
You acknowledge that “City News” is a proprietary trade mark (”trade mark” includes service marks) and that you may not use it without prior written permission from City News.
Linking: If you would like to link to the City News website, please read and comply with the following guidelines and all applicable laws. A site or service that links to the City News website:
- may display a City News logo and/or masthead but must not otherwise use the City News trade mark without permission from City News;
- may link only to the homepage of City News website unless City News has otherwise given prior written permission;
- may not remove, distort or otherwise alter the size or appearance of the logo;
- must not be a site or service that contains content that could be construed as distasteful or offensive, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, racially, ethnically or otherwise objectionable, or that could be prohibited by all relevant laws and legislation;
- must not in any way imply that City News is endorsing it and/or its products or services;
- must not misrepresent its relationship with City News or present false information about City News;
- must not be a site or service that infringes any intellectual property or other right of any person or that otherwise does not comply with all relevant laws and regulations.
City News expressly reserves the right to require that any link in breach of these terms and conditions be removed and to take whatever action it deems appropriate.
At Work Use: If you are using City News website in an “at work” capacity (whether for a company, partnership, public sector body, club, association, charity, etc.) and your use extends beyond personal, non-commercial use then you should contact City News at contactus@citynews.sg to discuss your business requirements, since it is possible that your use of City News Content extends beyond what is permitted by these terms and conditions. In particular, all requests to republish, redistribute or syndicate City News Content, whether headlines, full text articles (or parts thereof) or the right to use City News Content internally within your business (for example, as part of a regular information dissemination service or on a company Intranet) or any external use that you may make (for example, within client reports or briefings) should be addressed to us, as such use falls outside the scope of use permitted by these terms and conditions. 2. Privacy Statement and Registration
All information received by City News from your use of City News website may be used by City News and such use shall be in accordance with our Privacy Statement.
On registration, you must provide City News with accurate, complete registration information and it is your responsibility to update and maintain changes to that information on the applicable City News website registration pages. City News is entitled to rely on any information you provide to us. By accessing and using City News, you represent and warrant that all registration information you submit is truthful and accurate and that you will maintain the accuracy of such information and update the information as and when necessary.
Each registration is for a single user only. On registration, you will choose a user name and password (”ID”). City News does not permit any other person sharing your ID or access through a single ID being made available to multiple users on a network. City News may cancel or suspend your access to City News website if you do this without further obligation to you.
You are responsible for all use of City News website made by you or anyone else using your ID and for preventing unauthorised use of your ID. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID or any payment information, you must notify City News immediately by emailing us at contactus@citynews.sg
If you provide City News with an email address that will result in any messages City News may send you being sent to you via a network or device operated or owned by a third party (e.g. your employer or college) then you warrant that you are entitled to receive those messages. You also agree that City News may at any time, for any or no reason, with or without prior notice and without publicity, refrain from sending messages to you without notifying you, even if you have subscribed to receive them, if we receive a request from a third party to stop sending messages to you.
3. Technical Requirements and Site Security
The City News website is best viewed using the Internet browsers IE7 or Mozilla Firefox 3 at 1024×768 resolution. Any older browser versions may work but users could have limited browsing capability.
4. Disclaimer, Indemnity and Exclusion of Liability
The City News Content is only for your general information and use and is not intended to address your particular requirements. In particular, the City News Content does not constitute any form of advice, invitation, recommendation, representation, promotion or endorsement by City News related to any product listed or referred to or otherwise and is not intended to be relied upon by users in making (or refraining from making) any specific investment or other decisions. Appropriate independent advice should be obtained before making any such decision. Any agreements, transactions or other arrangements made between you and any third party named on (or linked to from) City News website are at your sole risk and responsibility.
Any information that you receive via City News website whether or not it is classified as “real time”, may have ceased to be current by the time it reaches you and share price or currency information may be rounded up/down and therefore not entirely accurate. City News is not responsible for any use of the City News Content by you outside its scope as stated in these terms and conditions.
City News assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, any City News Content. City News is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any equipment due to technical problems or traffic congestion on the Internet or on any of the City News website or combination thereof, including any injury or damage to users or to any person’s computer related to or resulting from accessing or downloading materials in connection with the City News website.
You agree to indemnify and hold the officers, agents, contractors, and employees of City News harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your access and use of the City News website, your connection to the City News website, your breach of these terms and conditions, or your violation of any rights of another in connection with your use of the City News website.
No Warranty: This website and the Materials are provided on an “as is” and “as available” basis. City News does not warrant the accuracy, adequacy or completeness of this website and/or the Materials and does not endorse or promote all or any part thereof and expressly disclaims liability for errors or omissions in the Materials. City News does not give any warranty in respect of City News website. To the extent permitted under applicable law, City News hereby disclaims all warranties, conditions or duties of every nature whatsoever, including without limitation, warranties of non-infringement of third party rights and/or title, any implied warranties of satisfactory quality, merchantability or of fitness for a particular purpose, any express or statutory warranties, and any warranties or duties regarding accuracy, timeliness, completeness, performance, availability or lack of negligence. City News does not warrant that this website and/or any of the Materials will be provided uninterrupted or free from errors or that any identified defect will be corrected; further, no warranty is given that this website and the Materials are free from any virus or other malicious, destructive or corrupting code, program or macro or anything else that has contaminating or destructive properties.
To the fullest extent permitted under applicable law, City News shall not be liable to you for any loss or damage, special or consequential, and including lost profits or loss of privacy or loss of or damage to data, arising whether or not as a direct or indirect consequence of:

5. Intellectual Property
You acknowledge that all City News Content and Trade Marks (as defined below) are subject to copyright, trade mark and other intellectual property rights under Singapore and foreign laws and international conventions acceded to by Singapore. 6. Non-Confidentiality

City News website contains links to other Internet websites or online and mobile services provided by independent third parties (”Third Party Sites”), either directly or through frames. Third Party Sites may be co-branded with City News and so include City News’s trade mark. City News is not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites. Inclusion of any Third Party Sites on the City News website does not imply approval or endorsement of the same by City News. When you access these Third Party Sites, you do so at your own risk. If you purchase products or services from a Third Party Site your contract for such products or services will be with the third party and not with City News. Our Privacy Statement does not apply to Third Party Sites.
Copyright in any software that is made available for download from City News website belongs to City News or its suppliers. Your use of the software is governed by the terms of any licence agreement that may accompany or be included with the software. City News is not responsible for any technical or other issues that may arise if you download third party software. Do not install or use any software unless you agree to such licence agreement.
The City News website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on City News website complies with all applicable laws. City News will not be responsible for any error or inaccuracy in advertising, promotional or sponsorship material.
8. Exclusion of Third Parties Rights
No person shall have any right pursuant to the Contracts (Right of Third Parties) Act (Cap.53B) to enforce any of the above terms and conditions.
The reference to a person, in this clause includes any individual, company, corporation, firm, partnership, joint venture, association, organization, trust, state or agency of a state (in each case, whether or not having separate legal personality).
9. Governing Law and Jurisdiction
By accessing this website, you agree that Singapore law, including without limitation the provisions of the Singapore Evidence Act (Cap. 97) and the Electronic Transactions Act (Cap. 88), shall govern such access as well as these terms and conditions and you agree to irrevocably submit to the exclusive jurisdiction of the Singapore courts to settle any dispute which may arise out of, under, or in connection with these terms and conditions.
10. General
These terms and conditions are accepted upon your use of the City News website and are further affirmed by you becoming registering with us. These terms and conditions constitute the entire agreement between you and City News regarding the use of the City News website.
The section titles in this Agreement are for convenience only and have no legal or contractual effect.
You may not assign, sub-license or otherwise transfer any of your rights or obligations under these terms and conditions.
This Agreement operates to the fullest extent permissible by law. If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.
Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.
